Acceptance of Terms

These Terms form a binding legal agreement between you and Gritty Rags, a sole proprietorship based in New Mexico, United States.
By using the Site or Services, you represent that you can form a legally binding contract and will comply with all applicable laws.

User Accounts

We may suspend or terminate your account without notice for violations of these Terms, suspicious activity, or legal requirements.

Orders and Payments

All orders placed through the Site constitute an offer to purchase; we reserve the right to accept or reject any order at our discretion, including for stock unavailability or compliance issues.
Prices are in U.S. dollars, exclude taxes and shipping (added at checkout), and are subject to change without notice; once submitted, your order price is fixed.
Payments are processed via secure third-party providers; you authorize charges to your selected method and are responsible for all fees, taxes, and currency conversions.
Orders cannot be canceled once production begins (typically within 24 hours); we will notify you of any issues via email.

Shipping and Delivery

We ship T-shirts via third-party carriers; estimated delivery times vary by location (generally 5-10 business days domestically, longer internationally) and are not guaranteed.
Title and risk of loss pass to you upon handover to the carrier; provide accurate shipping details to avoid delays or non-delivery.
We are not liable for shipping delays, losses, or damages once the package leaves our facility; track your order via the provided confirmation.
International shipments may incur additional customs fees, which are your responsibility.

Intellectual Property

All Site content, including designs, logos, and trademarks, is owned or licensed by Gritty Rags; you receive a limited, non-exclusive, revocable license for personal, non-commercial use.
You must not copy, modify, distribute, or reverse-engineer any Site materials without our written permission.
We respect third-party intellectual property and reserve the right to remove infringing content; submit DMCA notices to support@grittyrags.com with required details (e.g., signature, infringing material description).
By uploading designs, you warrant ownership or necessary rights and grant us a worldwide, royalty-free license to use them for order fulfillment and promotion.

User-Generated Content

Any designs, text, or images you upload (“User Content”) must be original, non-infringing, and comply with applicable laws; we do not prescreen but may remove violating material at our discretion.
You retain ownership of User Content but grant us a non-exclusive, perpetual, worldwide license to reproduce, distribute, display, and modify it for Services, including marketing.
Prohibited Content includes illegal, obscene, defamatory, or harmful material; you indemnify us against claims arising from your User Content.
We may use your User Content in aggregated, anonymized form for analytics or improvements.

Disclaimers and Limitation of Liability

The Site and Services are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.
We disclaim liability for errors, interruptions, viruses, or inaccuracies; you use the Site at your own risk.
To the fullest extent permitted by law, our total liability shall not exceed the amount you paid us in the six months preceding the claim; we are not liable for indirect, consequential, or punitive damages.

Termination

Upon termination, licenses granted to us end, but sections on liability, intellectual property, and indemnification survive.

These Terms are governed by the laws of the State of New Mexico, United States, without regard to conflict of laws principles. Any disputes shall be resolved exclusively in the state or federal courts located in New Mexico, to which you consent to personal jurisdiction.
